Social work isn’t just about being nice to people, and it’s not just an elevated form of volunteering. Social work is about doing thoughtful interventions using an evidence- or science-supported method.</p>\n<p>Social work uses the person-in-environment framework to inform how we understand the person and community/system that has an unmet need. Using this framework, social workers use a process called the<em> planned change model</em> to assess and address social problems. If you do, the client may come to expect this from you all the time — and it can hurt your business.\r\n<h2 id=\"tab4\" >Do what you say, say what you do</h2>\r\nWhen you tell the client to do something, you should do it. Sounds simple, right? Well, you'd be surprised at how many personal trainers forget this simple concept.\r\n<p class=\"Remember\">The best way to keep your word is to be prepared, to always be on time, and have your bag and files ready ahead of time. To make sure you always have a program ready for the client, have the client's file with you when you need it, and have a place where you can work — a place with a desk, adequate lighting, and all the tools you'll need to stay on top of things. And be sure to have access to all the health information you need so that if you tell a client you'll bring her a recipe or a new exercise or information about heart disease, you can have it ready the next time you see her.</p>\r\n\r\n<h2 id=\"tab5\" >Showing clients you care</h2>\r\nCare is more than just a four-letter word. It also stands for \"Clients Are Really Everything.\" You may know everything there is to know about personal training, but you wouldn't be much of a personal trainer without your clients. You can either cheat the client out of a few minutes of training so she can be done at 5 p.m., or you can run late — which is annoying for a busy person (and who <i>isn't</i> busy?).\r\n<p class=\"Tip\">If you're always late, ask yourself why and come up with a solution. Do you get stuck in traffic? If so, find alternate routes or leave earlier. Do you have trouble getting yourself out the door? Have your bag, your client folder, and everything else you need ready by the door early in the day so you can grab it and leave when the time comes. You can even buy a shelf or hook to keep your stuff on — it may motivate you to use it.</p>\r\n\r\n<h2 id=\"tab7\" >Dress professionally</h2>\r\nHere are some dress-for-success tips:\r\n<ul>\r\n \t<li>We'll say it again — no skintight spandex!</li>\r\n</ul>\r\n<ul>\r\n \t<li>Don't wear jeans and a T-shirt, no matter how comfy they are.</li>\r\n</ul>\r\n<ul>\r\n \t<li>Make sure your clothes aren't too baggy. If you demonstrate a machine, your clothes may get caught.</li>\r\n</ul>\r\n<ul>\r\n \t<li>Women, don't slather on the makeup. (Guys, this goes double for you!)</li>\r\n</ul>\r\n<ul>\r\n \t<li>Keep jewelry to a minimum. Long, dangly jewelry can get caught in the machines.</li>\r\n</ul>\r\n<ul>\r\n \t<li>The same goes for long, loose hair. If you have long hair, you may want to pull it back.</li>\r\n</ul>\r\n<ul>\r\n \t<li>The best uniform may be a collared polo shirt, well-fitting sweatpants, and good-quality exercise shoes.</li>\r\n</ul>\r\n<h2 id=\"tab8\" >Stay educated</h2>\r\nPersonal trainers need to stay up-to-date in medicine, fitness, business, and even psychology and nutrition. That's why you have to care about them.\r\n<p class=\"Tip\">Here are some tips for showing clients that you care:</p>\r\n\r\n<ul>\r\n \t<li>Return phone calls promptly.</li>\r\n</ul>\r\n<ul>\r\n \t<li>Return e-mails promptly.</li>\r\n</ul>\r\n<ul>\r\n \t<li>Follow up with your clients to make sure the sessions are working for them.</li>\r\n</ul>\r\n<ul>\r\n \t<li>Send your clients thank-you cards for doing business with you.</li>\r\n</ul>\r\n<ul>\r\n \t<li>Always be sympathetic to your clients' complaints.</li>\r\n</ul>\r\n<ul>\r\n \t<li>Keep individual files on each client so you can track them and create the most personalized programs for them.</li>\r\n</ul>\r\n<h2 id=\"tab6\" >Always be on time</h2>\r\nBeing late shows a lack of respect for the person who is waiting. Not only that, but if you have a personal training session and you show up late, what are your choices? You can either cheat the client out of a few minutes of training so she can be done at 5 p.m., or you can run late — which is annoying for a busy person (and who <i>isn't</i> busy?).\r\n<p class=\"Tip\">If you're always late, ask yourself why and come up with a solution. Do you get stuck in traffic? If so, find alternate routes or leave earlier. Do you have trouble getting yourself out the door? Have your bag, your client folder, and everything else you need ready by the door early in the day so you can grab it and leave when the time comes. You can even buy a shelf or hook to keep your stuff on — it may motivate you to use it.</p>\r\n\r\n<h2 id=\"tab7\" >Dress professionally</h2>\r\nHere are some dress-for-success tips:\r\n<ul>\r\n \t<li>We'll say it again — no skintight spandex!</li>\r\n</ul>\r\n<ul>\r\n \t<li>Don't wear jeans and a T-shirt, no matter how comfy they are.</li>\r\n</ul>\r\n<ul>\r\n \t<li>Make sure your clothes aren't too baggy. If you demonstrate a machine, your clothes may get caught.</li>\r\n</ul>\r\n<ul>\r\n \t<li>Women, don't slather on the makeup. (Guys, this goes double for you!)</li>\r\n</ul>\r\n<ul>\r\n \t<li>Keep jewelry to a minimum. Long, dangly jewelry can get caught in the machines.</li>\r\n</ul>\r\n<ul>\r\n \t<li>The same goes for long, loose hair. If you have long hair, you may want to pull it back.</li>\r\n</ul>\r\n<ul>\r\n \t<li>The best uniform may be a collared polo shirt, well-fitting sweatpants, and good-quality exercise shoes.</li>\r\n</ul>\r\n<h2 id=\"tab8\" >Stay educated</h2>\r\nPersonal trainers need to stay up-to-date in medicine, fitness, business, and even psychology and nutrition. Although you want to be training other people — not be trained yourself — spending time with someone who's been doing it for a while and is successful at it can be worth way more than the money you shell out for the session.\r\n\r\nTrust us, if you tell your trainer that you're interested in being a personal trainer, too, and you'd like to work with him for a couple of sessions to get a feel for it, he'll be delighted. For the most part, trainers are very supportive of one another — a good personal trainer will want to see you succeed.\r\n<p class=\"article-tips tip\">A bonus to working with another trainer is that, when you do get certified and start training clients, you have a colleague whom you can call when you need help troubleshooting or you just need a quick answer to a question.</p>\r\n\r\n<h2 id=\"tab4\" >Taking advantage of other learning opportunities</h2>\r\nIf you belong to a gym, work out with a friend who's slightly less advanced than you are. While you're working out with her, practice your training and spotting techniques. Your partner won't mind — after all, she's going to get stronger as a result of your practice!\r\n\r\nIf you can't find anyone to work out with, try role-playing. (And no, we don't mean meeting your significant other at the local watering hole wearing a wig and dark glasses.) While you're working out, run through a mental dialogue of what you would say to yourself if you were the client. Practice explaining what the exercises do and which muscle groups are involved in the exercise. Just be sure to do this in your head, not out loud. Practicing your dialogue prevents you from being tongue-tied when you're working with a live, flesh-and-blood client.\r\n\r\nOne great way to expand your mind and elevate your glass ceiling is to visit the leaders of your profession — and what better way to do that than to visit a conference? Try attending conferences put on by different certifying bodies or groups such as <a href=\"//www.ideafit.com\" target=\"_blank\" rel=\"noopener\">IDEA</a> or the <a href=\"//www.nsca.com\" target=\"_blank\" rel=\"noopener\">National Strength and Conditioning Association</a> — click on Meetings. Also check out the seminars by <a href=\"//www.neseminars.com\" target=\"_blank\" rel=\"noopener\">Northeast Seminars</a>, an outfit that gathers some of the top people in the fitness and rehab industries to discuss functional training and rehabilitation.\r\n<p class=\"Remember\">Study or practice one of your training skills every day. Read up on medical literature, listen to a lecture at the hospital on preventing back injuries, practice stretching a friend. Often, though, my coaching clients have struggled to come up with smart questions. You don’t want to just get hired — you want to be a superstar.</p>\n<p>Next, it’s a helpful way to gather information beyond the job description and the usual list of requirements. You’re asking the interviewer to focus on the most important aspects and share some details about why they’re critical. This can bring out a lot of useful context about what the job involves and what success looks like to the interviewer.</p>\n<p>For this reason, it’s also a question you can ask of any interviewer. You can even ask this same question of multiple people and gain different insights.</p>\n<h3>What are your company&#8217;s (or department&#8217;s or team&#8217;s) top priorities right now?</h3>\n<p>This question shows that you care about the top priorities and truly want to understand how you can help.</p>\n<p>You can also tailor this question. You can ask about top priorities for the company overall, for the department, for the team, for the initiative, or for the role alone.</p>\n<p>Asking this question shows that you take initiative and think critically. It also shows genuine enthusiasm for learning more about the job and a true interest in the interviewer’s perspective on critical upcoming tasks and how you might contribute.</p>\n<h3>What do you personally like most about working here?</h3>\n<p>With this question, you show that you’re imagining yourself as part of the team and you’re eager to learn more about the culture and work environment.</p>\n<p>By framing it this way, you focus on your interviewer’s personal perspective. This strategy shows respect for their point of view, which can help you build rapport.</p>\n<p>Asking for a personal opinion also helps you move past the standard rhetoric of “This place is awesome!” You’re more likely to hear details about what it’s really like to work on the team.</p>\n<h3>Can you tell me about a typical day on the job?</h3>\n<p>This question is a bit more general, but if the interviewer hasn’t shared much information about the role, asking this one can help you uncover the insights you need.</p>\n<p>You want to know as much as possible about what the job entails so that you can tailor your stories and lead with your greatest hits.</p>\n<p>Asking this question is also a good way to translate a long, generalized list of job requirements (the typical job description, in other words) into a true understanding of how the job plays out from day to day.</p>\n<p>When the interviewer states that Excel is critical, for example, is it because you have to update a simple spreadsheet every week or because they expect you to spend every waking hour creating pivot tables and advanced financial models? Now you must ensure that you set yourself up for success by negotiating the best compensation and employment terms possible.</p>\n<p>Many applicants simply accept the first offer for fear of jeopardizing it. This approach often leaves money and perks on the table.</p>\n<p>Think of it this way: Now you finally have some real power. They want to hire you. They selected you over all the other candidates. You have some leverage to ask for what you want.</p>\n<p>Early in the interview process, both you and the employer will likely try to determine if there&#8217;s a general match in terms of compensation. Ideally, they will disclose a salary range that is in line with what you’re seeking. This increases the odds that the offer, when it comes, will at least be in the right ballpark.</p>\n<h3>Determining when to negotiate</h3>\n<p>There’s always a chance that the initial offer will exceed your expectations and you can skip negotiation and go straight to celebration.</p>\n<p>However, most employers leave some room for negotiation when making their first offer.</p>\n<p>Here are a few questions to ask yourself before deciding to negotiate:</p>\n<ul>\n<li><strong>Is the offer fair?</strong> If you’ve done your research, you will know how the offer compares to the market rate for the position and for your experience and qualifications.</li>\n<li><strong>Does the offer excite you?</strong> Beyond basic fairness, the ideal offer would be one that makes you feel you are truly valued and demonstrates that the company would be a great long-term home for you.</li>\n<li><strong>Does there seem to be room to negotiate?</strong> Sometimes the company is expecting you to negotiate and has already built in room to increase the offer if you ask for it. In other cases, the company has very firm salary bands and there may not be a budget to go higher. It’s hard to know for sure, but you may be able to pick up some clues during the interview process.</li>\n</ul>\n<h3>Considering a counteroffer</h3>\n<p>If you&#8217;ve done your research, you&#8217;ll know if that initial offer is generous or stingy. If the number seems less than competitive, you should feel free to counter.</p>\n<p>However, before you respond, you need to clarify what you want and what’s most important for you at this stage in your career.</p>\n<p>If the offer is so low that it makes you seriously question whether to accept it, you don’t have much to lose by trying to negotiate.</p>\n<p>If you’re relatively happy with the offer but would be thrilled if it were just a little higher, it probably makes sense to see if they have some flexibility.</p>\n<p>If the offer is already very generous, you may want to question whether it’s worth it to push for more.</p>\n<p>Other factors to take into consideration here:</p>\n<ul>\n<li><strong>Have you had previous conversations about salary range?</strong> If the company has already talked about budget limitations or a range lower than you’d like, you can anticipate a more challenging negotiation.</li>\n<li><strong>How much do they seem to love you?</strong> If they really want you, they will be more motivated to make you happy.</li>\n<li><strong>What’s your bottom line?</strong> If you have other options and are willing to walk away, you have more leverage. If you really want the job, even if it’s at a lower-than-ideal, you need to be more careful.</li>\n</ul>\n<h3>Asking for more</h3>\n<p>If you decide to counter, you must approach the conversation with some diplomacy. After all, you want to get the best possible offer you can get without jeopardizing a &#8220;good enough&#8221; offer.</p>\n<p>First, make it clear that you are delighted to receive an offer and very interested in the position. Express gratitude and establish a friendly basis for the counteroffer.</p>\n<p>If you were caught by surprise, it’s okay to ask for a little time to consider the offer. You could say something like, “I’m very excited about the offer, but I’d like a little time to consider the details before making a final decision.”</p>\n<p>Then, take a few deep breaths and consider what your counteroffer should be. What number would make you feel 100% happy to accept the offer, keeping in mind the realistic market rate for the position in your location?</p>\n<p>Try countering with a number slightly above what would make you happy. The most likely response is that they will reply with an offer higher than the initial number, but lower than what you asked for. From there, the end game is bartering until you reach a number both sides can live with.</p>\n<h3>Get it in writing!</h3>\n<p>Once you&#8217;ve reached an agreement and accepted the offer, make sure you receive a written offer letter that includes all of the details that were negotiated.</p>\n<p>Until you have the offer in writing, it&#8217;s just talk. That means you should keep your other options open. However, if you deny housing to an applicant based on information contained in the credit report, you must provide the applicant with an adverse action notice that includes the following information:\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">The name, address, and telephone number of the credit-reporting agency (CRA) that supplied the credit report, including a toll-free telephone number for CRAs that maintain files nationwide</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">A statement that the CRA that supplied the report didn't make the decision to take the adverse action and can't give the specific reasons for it</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">A notice of the applicant's right to dispute the accuracy or completeness of any information provided in the credit report, and the applicant's right to a free report from the CRA upon request within 60 days</p>\r\n</li>\r\n</ul>\r\nThe FCRA also comes into play if you want to report the nonpayment of rent to one or more CRAs. If you report a resident for nonpayment of rent and the resident cures the debt, you're legally obligated to update the resident's credit report to indicate that the debt has been cured.\r\n<h2 id=\"tab3\" >The implied warranty of habitability</h2>\r\nThe <i>implied warranty of habitability</i> requires that landlords provide residents with living space that's fit for human occupancy. To be habitable, living space must have heat when it's cold, running water, a sufficient amount of hot water, plumbing and electricity that function properly, and so on. Landlords must also maintain clean and sanitary buildings and grounds — free of debris, filth, rubbish, garbage, rodents, and vermin.\r\n\r\nIf a rental unit is uninhabitable, residents have the right to withhold rent until the necessary repairs are made or, in more serious situations, terminate the lease.\r\n<p class=\"Remember\">Although your residents are responsible for repairing anything they or their guests break, you're required to perform any repairs required to maintain fit and habitable living conditions, and you must complete the repairs in a reasonable period of time.</p>\r\n\r\n<h2 id=\"tab4\" >The mutual covenant of quiet enjoyment</h2>\r\nImplied in every lease and rental agreement is the <i>mutual covenant of quiet enjoyment</i>, which grants all residents the right to the undisturbed use and enjoyment of the rental property. This covenant applies to you, as landlord, in two ways:\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">You're not allowed to enter a resident's unit whenever you want. You can enter in an emergency that threatens life or property, when you ask and the resident gives you permission, and to perform necessary inspections or repairs or show the unit to prospective renters or buyers (only after giving the resident sufficient notice).</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">You need to reasonably investigate complaints and potentially take action against any resident who's disturbing his neighbors.</p>\r\n</li>\r\n</ul>\r\n<h2 id=\"tab5\" >Your state's security deposit rules</h2>\r\nEvery state has a security deposit statute that typically specifies the following:\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">How the security deposit is to be held — usually in an interest-bearing account in an in-state bank</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">What the security deposit may be used for — usually to cover unpaid rent, damage beyond ordinary wear and tear, and cleaning to make the unit as clean as it was when the resident moved in and sometimes to repair or replace the landlord's personal property in the unit if that use is mentioned in the lease</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">When the unused portion of the security deposit must be returned to the resident</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">That the landlord provide an itemized invoice of any money deducted from the security deposit</p>\r\n</li>\r\n</ul>\r\n<p class=\"Remember\">Disputes over security deposits are common and frequently lead to the resident taking legal action against the landlord. To protect yourself, comply with your state statute, and take the following precautions as good business practices, even if it isn't required under the applicable statute:</p>\r\n\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Have a separate interest-bearing account for holding security deposits.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Complete a move-in/move-out checklist to document the condition of the property at the beginning and end of a resident's stay.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Take photos or video of the property to create a visual record of the property's condition at the beginning and end of a resident's stay.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Keep receipts for <i>all</i> repairs and cleaning required to prepare the unit for the next resident, even though you're permitted to charge the resident only for damage beyond ordinary wear and tear, and cleaning to make the unit as clean as it was when the resident moved in.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Return the unused portion of the security deposit to the resident as soon as possible as required by state law.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Along with the unused portion of the security deposit, include an itemized list of all costs deducted from the security deposit.</p>\r\n</li>\r\n</ul>\r\n<h2 id=\"tab6\" >The Residential Lead-Based Paint Hazard Reduction Act</h2>\r\nThe Residential Lead-Based Paint Hazard Reduction Act, in part, requires that landlords inform residents of the hazards posed by lead-based paint. If your rental property was built prior to 1978 (the year the EPA banned lead paint) you're required by law to do the following:\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Disclose all known lead-based paint and lead-based paint hazards and any available reports on lead in the property.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Give renters the EPA pamphlets \"Protect Your Family From Lead in Your Home\" and \"The Lead-Safe Certified Guide to Renovate Right.\"</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Include certain warning language in the lease as well as signed statements from all parties verifying that all requirements were completed.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Retain signed acknowledgments for three years, as proof of compliance.</p>\r\n</li>\r\n</ul>\r\nHousing that is exempt from this rule include the following:\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Units that have no bedrooms, such as lofts, efficiencies, and studio apartments</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Short-term rentals of fewer than 100 days</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Housing designated for the elderly or the handicapped unless children live or are expected to live there</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Property that's been inspected by a certified inspector and found to be free of lead-based paint</p>\r\n</li>\r\n</ul>\r\n<h2 id=\"tab7\" >State-required disclosures</h2>\r\nIn addition to the federal lead-based paint disclosure, many states require that landlords disclose one or more of the following:\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Environmental hazards, including periodic pest control and herbicide treatments, toxic mold, asbestos, radon gas, bedbug infestation, and methamphetamine contamination</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Recent flooding or location in a flood zone</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Security deposit policies and procedures</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Nonrefundable fees, such as a pet fee, where such fees are allowed</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Smoke detector location and maintenance requirements</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Nearby military ordinance, such as a US Army base</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Smoking policy</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Landlord's or property manager's name and contact information</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Any shared utility arrangement</p>\r\n</li>\r\n</ul>\r\n<h2 id=\"tab8\" >Your state's Landlord Tenant Act</h2>\r\nNearly every state has a version of the Landlord Tenant Act, which defines the rights and obligations of the landlord and the tenant (also known as the <i>resident</i>), legal remedies for breach of contract, possible defenses to legal actions, and much more. To find your state's landlord tenant act, search the web for your state's name followed by \"landlord tenant act\" and click one of the links that looks promising. If that doesn't work, track down your state's official website, and search that site specifically for something like \"landlord tenant\" or \"residential rental laws.\"\r\n<h2 id=\"tab9\" >Eviction rules and procedures</h2>\r\nIf you need to evict a resident, turning off electricity, gas, and water to the unit to compel the resident to leave is illegal. You must follow your state's eviction rules and procedures, which typically require that you perform the following steps:\r\n<ol class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Check your state's landlord tenant act to find out whether you have legal grounds to evict the resident.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Give the resident reasonable notice of your intent to file for eviction, including the reason you intend to do so and, if required by state law, the time the resident has to address the issues.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Wait until the morning after the deadline specified in your notice, and then file for an eviction hearing at your county's courthouse.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Assuming you prevail in court, wait until the day after the court's deadline for the resident to move out, and if the resident hasn't moved out yet, call the sheriff to evict the resident.</p>\r\n</li>\r\n</ol>\r\n<p class=\"Warning\">Failure to follow your state's eviction process could result in your losing your case. The resident may end up living in the property for some time, perhaps without paying rent. In addition, the resident may be able to file a legal claim against you in civil court and force you to pay damages, legal fees, and penalties.</p>\r\n\r\n<h2 id=\"tab10\" >Mitigation of damages</h2>\r\nWhen a resident breaches a lease, for example by moving out three months into a one-year lease, the resident is obligated by the contract to continue to pay rent. However, you can't just let the unit remain vacant for nine months. You're legally obligated to take steps to mitigate (lessen) the resident's losses. To protect yourself, comply with your state statute, and take the following precautions as good business practices, even if it isn't required under the applicable statute:</p>\r\n\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Have a separate interest-bearing account for holding security deposits.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Complete a move-in/move-out checklist to document the condition of the property at the beginning and end of a resident's stay.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Take photos or video of the property to create a visual record of the property's condition at the beginning and end of a resident's stay.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Keep receipts for <i>all</i> repairs and cleaning required to prepare the unit for the next resident, even though you're permitted to charge the resident only for damage beyond ordinary wear and tear, and cleaning to make the unit as clean as it was when the resident moved in.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Return the unused portion of the security deposit to the resident as soon as possible as required by state law.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Along with the unused portion of the security deposit, include an itemized list of all costs deducted from the security deposit.</p>\r\n</li>\r\n</ul>\r\n<h2 id=\"tab6\" >The Residential Lead-Based Paint Hazard Reduction Act</h2>\r\nThe Residential Lead-Based Paint Hazard Reduction Act, in part, requires that landlords inform residents of the hazards posed by lead-based paint. If your rental property was built prior to 1978 (the year the EPA banned lead paint) you're required by law to do the following:\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Disclose all known lead-based paint and lead-based paint hazards and any available reports on lead in the property.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Give renters the EPA pamphlets \"Protect Your Family From Lead in Your Home\" and \"The Lead-Safe Certified Guide to Renovate Right.\"</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Include certain warning language in the lease as well as signed statements from all parties verifying that all requirements were completed.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Retain signed acknowledgments for three years, as proof of compliance.</p>\r\n</li>\r\n</ul>\r\nHousing that is exempt from this rule include the following:\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Units that have no bedrooms, such as lofts, efficiencies, and studio apartments</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Short-term rentals of fewer than 100 days</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Housing designated for the elderly or the handicapped unless children live or are expected to live there</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Property that's been inspected by a certified inspector and found to be free of lead-based paint</p>\r\n</li>\r\n</ul>\r\n<h2 id=\"tab7\" >State-required disclosures</h2>\r\nIn addition to the federal lead-based paint disclosure, many states require that landlords disclose one or more of the following:\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Environmental hazards, including periodic pest control and herbicide treatments, toxic mold, asbestos, radon gas, bedbug infestation, and methamphetamine contamination</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Recent flooding or location in a flood zone</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Security deposit policies and procedures</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Nonrefundable fees, such as a pet fee, where such fees are allowed</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Smoke detector location and maintenance requirements</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Nearby military ordinance, such as a US Army base</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Smoking policy</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Landlord's or property manager's name and contact information</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Any shared utility arrangement</p>\r\n</li>\r\n</ul>\r\n<h2 id=\"tab8\" >Your state's Landlord Tenant Act</h2>\r\nNearly every state has a version of the Landlord Tenant Act, which defines the rights and obligations of the landlord and the tenant (also known as the <i>resident</i>), legal remedies for breach of contract, possible defenses to legal actions, and much more. To find your state's landlord tenant act, search the web for your state's name followed by \"landlord tenant act\" and click one of the links that looks promising. If that doesn't work, track down your state's official website, and search that site specifically for something like \"landlord tenant\" or \"residential rental laws.\"\r\n<h2 id=\"tab9\" >Eviction rules and procedures</h2>\r\nIf you need to evict a resident, turning off electricity, gas, and water to the unit to compel the resident to leave is illegal. You must follow your state's eviction rules and procedures, which typically require that you perform the following steps:\r\n<ol class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Check your state's landlord tenant act to find out whether you have legal grounds to evict the resident.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Give the resident reasonable notice of your intent to file for eviction, including the reason you intend to do so and, if required by state law, the time the resident has to address the issues.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Wait until the morning after the deadline specified in your notice, and then file for an eviction hearing at your county's courthouse.</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Assuming you prevail in court, wait until the day after the court's deadline for the resident to move out, and if the resident hasn't moved out yet, call the sheriff to evict the resident.</p>\r\n</li>\r\n</ol>\r\n<p class=\"Warning\">Failure to follow your state's eviction process could result in your losing your case. The resident may end up living in the property for some time, perhaps without paying rent. In addition, the resident may be able to file a legal claim against you in civil court and force you to pay damages, legal fees, and penalties.</p>\r\n\r\n<h2 id=\"tab10\" >Mitigation of damages</h2>\r\nWhen a resident breaches a lease, for example by moving out three months into a one-year lease, the resident is obligated by the contract to continue to pay rent. However, you can't just let the unit remain vacant for nine months. You're legally obligated to take steps to mitigate (lessen) the resident's losses. In this example, ways to mitigate the damages include:\r\n<ul class=\"level-one\">\r\n \t<li>\r\n<p class=\"first-para\">Accepting a replacement the resident recommended to rent the unit for the months remaining on the lease, assuming the recommended replacement qualifies</p>\r\n</li>\r\n \t<li>\r\n<p class=\"first-para\">Advertising the unit to find a new resident, screening applicants, showing the unit to qualified applicants, and so on</p>\r\n</li>\r\n</ul>\r\n<p class=\"Tip\">Gather evidence of your attempts to re-rent the property, such as advertisements, records of applicants you screened, and dates on which you showed the property to qualified applicants.</p>","blurb":"","authors":[{"authorId":9293,"name":"Robert S.
